The 2023 IP Trend Monitor Report, presented by the Dennemeyer Group in collaboration with CTC Legal Media, assesses eight pivotal sectors: automotive, biotechnology, energy, digital media, ICT, medical devices, pharmaceuticals, and space technology. With insights gathered from over 1,800 IP professionals, this comprehensive study also forecasts the shifting landscapes that businesses and IP practitioners alike must navigate.

Automotive Sector With advancements in battery technology, underscoring the transition towards electric vehicles (EVs) and the subsequent shift in IP focus towards sustainable energy solutions. This sector’s growth is intricately linked to patents, highlighting the importance of innovation in meeting global sustainability goals.

Biotechnology is at the forefront of healthcare innovation, with the spotlight on new drug compounds and genetic therapies. Open innovation and sharing of research findings will have greater importance in this industry, although this development is likely to be cautious in view of potential IP disputes.  

The Energy Industry‘s pivot to renewable sources emphasizes the urgency for inventive energy storage solutions (there is currently no one solution). To overcome the current energy storage and supply problems will require a balancing of collaboration with the need/want for exclusive IP rights. The different parties must find a way to work together without losing entitlement to IP-generated compensation.

Digital Media faces the conundrum of defending against deepfakes, with the sector at a crossroads between protecting creative rights and embracing the disruptive potential of AI. This highlights a pressing need for innovative licensing models to adapt to rapidly changing consumer behaviors and technological advancements.

Medical Devices emphasize the paramount importance of data protection in an age where wearable technologies blur the lines between healthcare and personal data privacy. The industry’s trajectory is heavily patent-dependent, reflecting the critical role of IP in safeguarding innovations that are central to advancing human health.

Information and Communications Technology (ICT) anticipates a profound impact from AI and machine learning, projecting a future where software protection and data security become central tenets of IP strategy. The sector’s evolution is a testament to the rapid pace of technological change and its expansive influence across industries.

Pharmaceuticals struggle with the dual challenges of promoting research through strong IP protection and ensuring equitable access to medicines. The industry’s exploration of AI in drug discovery brings to light complex issues around data ownership and inventorship, necessitating a balanced approach to IP and open innovation.

Space Technology remains a nascent field with untapped potential, where telecommunications and satellite services present significant IP challenges. As private sector involvement grows, so does the need for clear IP strategies to navigate the uncharted territories of space exploration.
